The development of Islamic banking from the establishment of the first Sharia Bank, namely Bank Muamalat, continues to develop. Regulations related to Sharia Banking in Indonesia are very supportive, estimated to increase by 356.25% annually. This study aims to see how the application of the concept of mudharabah in Islamic banking in Indonesia is based on the perspective of fiqh. From the results of the study it can be concluded that the idea of mudharabah in traditional fiqh studies is fundamentally different from that used in Islamic financial institutions. This variation is evident in the way working capital is provided, how the business is managed, how long the mudharabah period is restricted, how the mudharabah pattern is used, and how collateral is provided for mudharabah assets. Banks should consider the principle of prudence when lending money, and in order for Islamic banking to follow this principle, the idea of mudharabah should be modified in order to be used and expanded in the banking industry.
